OVERSIGHT BY PROVIDENCE COUNTY HIGH SHERIFF AND STATEWIDE SERVICE OF PROCESS

WHEREAS, the public interest is served through the effective delivery of services by the sheriffs and deputy sheriffs of the State and efficient management of such personnel on a statewide basis.

WHEREAS, Article 9 Section 3 of the Rhode Island Constitution makes the Governor the Chief Executive Officer of the State.

WHEREAS, as Chief Executive the Governor is charged with ensuring that the laws of the State are faithfully and uniformly executed, and, as part of that duty the Governor oversees the activities of the sheriffs of the State.

WHEREAS, pursuant to R.I. Gen. Laws § 42-29-1 et seq. (the "Statute") the Governor possesses the sole power to appoint and remove for just cause the sheriffs of the several counties in addition to the power to approve and oversee all duties performed by sheriffs and their deputies.

WHEREAS, the Statute established a system whereby the Governor appoints a sheriff for Providence, Kent, Bristol, Newport and Washington counties as well as a deputy high sheriff for Providence County.

WHEREAS, the sheriffs of each county, with approval of the Governor, appoint deputies, which presently number approximately 100 in Providence, 22 in Kent, 16 in Washington, 15 in Newport and 4 in Bristol.

4. For a period expending 120 days from the date of this Order/ the sheriffs/ deputy sheriffs and deputy sheriff clerks of each county shall be sworn in in each county statewide and empowered to serve process and perform other duties in each county as directed by the High Sheriff of Providence County.

This Order will take effect immediately.
