REORGANIZATION OF THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT

WHEREAS, the Director of the Department of Environmental Management is vested with all the administrative powers and duties vested by law in the Department pursuant to the provisions of R.I. Gen. Laws § 42-6-1 et seq.; and

WHEREAS, the Director is authorized pursuant to the provisions of R.I. Gen. Laws § 42-6-8 to direct Department officers and employees, and with the approval of the Governor, may establish within the Department such subdivisions or other administrative organization units that the Director deems desirable to expedite the work of the Department in accordance with good administrative principles and practices to serve the interests of economy, the environment, efficiency; and

WHEREAS, these goals are best served at this time by reorganizing the Department inro a more streamlined environmental management program for the State of Rhode Island; and

WHEREAS, the cooperative federal and state programs must continue uninterrupted to maintain Federal Delegation and "One Stop Shopping" for Rhode Island businesses and industries; and

WHEREAS, the Department has recently completed a management review, focusing on consolidation and efficiencies in the Department's function and activities, which proposed an amended management structure designed to provide effective, efficient and uninterrupted departmental operations and services; and

WHEREAS, since its inception, the Department has been reorganized by several Governors through Executive Order to better meet then-existing needs and conditions.

NOW, THEREFORE, I, LINCOLN ALMOND, by virtue oŁ the authority vested in me as Governor of the State of Rhode Island and Providence Plantations and the provisions of R.I. Gen. Laws § 42-6-5 do hereby order as follows:

1. The Department of Environmental Management shall be reorganized to more efficiently and productively serve the citizens of the State of Rhode Island.

2. The Department will be headed by the Director of Environmental Management who shall be designated as Commissioner and shall have all powers and duties currently held by the Director including but not limited to those set forth in sections 42-17.1-1 et seq. of the Rhode Island General Laws. The following positions will report to the Commissioner: the Bureau Chief of Policy and Administration, the Bureau of Natural Resources, the Bureau Chief of Environmental Protection, and the Directors of Administrative Adjudication, Legal Services and Criminal Investigation.

3. The Bureau Chief of Policy and Administration shall be responsible for the Offices of Human Resources, Management Services and Program Development.

4. The Bureau Chief of Natural Resources shall be responsible for the Office of Recreational Services, Law Enforcement and Natural Resource Services, which shall include programs in agriculture, forestry, fish and wildlife, and coastal resources.

5. The Bureau Chief of Environmental Protection shall be responsible for the Offices of Technical and Customer Assistance, Air Resources, Waste Management, Water Resources and Compliance and Inspection. All offices shall report the Deputy Bureau Chief for Environmental Protection except for the Office of Technical and Customer Assistance which shall report directly to the Bureau Chief of Environmental Protection.

6. The Commissioner of the Department of Environmental Management is hereby empowered to make any necessary transfers of personnel and physical property within the Department to carry out the purposes and intent of this Executive Order and is further empowered to establish sections within any division consistent with said purpose.

7. The Director of Administration is authorized to establish such accounts within the offices established herein as are necessary to implement the terms of this Order.

This Executive Order shall take effect immediately upon the date hereof.
