REORGANIZATION OF THE DEPARTMENT OF BUSINESS REGULATION

WHEREAS, the Director of the Department of Business Regulation, is vested with all the administrative powers and duties vested by law in the Department pursuant to the provisions of R.I. Gen. Laws § 42-S-1 et. seq.: and

WHEREAS, the Director is authorized pursuant to the provisions of R.I. Gen. Laws § 42-5-8 to direct Department officers and employees, and with the approval of the Governor, may establish within the Department such subdivisions or other administrative organization units Chat the Director deems desirable Co expedite the work of the Department in accordance with good administrative principles and practices Co serve the interests of the public, economy and efficiency; and

WHEREAS, che consolidation of certain regulatory divisions and units within the Department of Business Regulation will improve the efficiency of its operations.

NOW, THEREFORE, I, LINCOLN ALMOND, by virtue of the authority vested in me as Governor of the State of Rhode Island and Providence Plantations and the provisions of R.I. Gen. Laws § 42-6-5 do hereby order as follows:

1. The Department of Business Regulation shall be reorganized to more efficiently and productively serve the citizens of the State of Rhode Island.

2. Within the Department of Business Regulation there shall be a Central Management (Director's Office) and five Divisions: Insurance, Banking, Securities, Racing and Athletics, and Commercial Licensing & Regulation.

3. Central Management shall be responsible for the establishment and implementation of departmental policy and the management of agency operations and its five divisions, including but; not limited to legal, budget, personnel, legislative and computer activities. Central Management shall be administered by the Director or his designees.

4. The Insurance Division shall be responsible for the administration of laws and regulations relating to the oversight of domestic and foreign insurance companies and related charters and licensing activities. The Insurance Division shall be administered by the Associate Director & Superintendent of Insurance.

5. The Banking Division shall be responsible for the administration of laws and regulations relating to the oversight of state-chartered financial institutions, credit unions, other organizations subject to the banking laws and related licensing activities. The Banking Division shall be administered by the Associate Director & Superintendent of Banking.

6. The Securities Division shall be responsible for the administration of laws and regulations relating to brokers, salespersons, investment advisors, and investment advisor representatives, the Rhode Island Franchise Investment Act, charitable and fund raising organizations/ and related licensing activities. The Securities Division shall be administered by the Associate Director Sc. Superintendent of Securities.

7. The Division of Racing & Athletics shall be responsible for the administration of laws and regulations relating to dog racing, jai alai, boxing, kick boxing and wrestling and related licensing activities. The Division of Racing & Athletics shall be administered by the Associate Director and Superintendent of Racing & Athletics.

8. The Division of Commercial Licensing & Regulation shall be responsible for the adminiscration of laws and regulations relating to the oversight of specified disciplines including real estate brokers and salespersons, certain segments of the alcoholic beverage industry, automobile body repair shops, auco wrecking and salvage yards, travel agencies and travel agents, upholsterers, hearing aid dealers and fitters, mobile parks and homes, false advertising, motor fuel advertising, unit pricing, and such other activities as from time to time the Director of the Department of Business Regulation shall designate. The Division of Commercial Licensing & Regulation shall be administered by the Associate Director, Division of Commercial Licensing & Regulation.

9. The Board of Accountancy is autonomous and may receive administrative support services with the approval of the Director.

10. The Director of the Department of Business Regulation is hereby empowered to make any necessary transfers of personnel and physical property within the Department of Business Regulation as well as any personnel adjustments and assignment as the Director deems necessary to carry out the purpose and intent of this order and is hereby empowered to establish sections within any division consistent with said purpose.

11. The Budget Officer is hereby directed to make recommendations to the Governor for the transfer of appropriations within the Department of Business Regulation consistent with state laws Co carry out the purpose and intent of this order.

12. Executive Order 84-11 dated November 9, 1984 and Executive Order 89-17 dated July 20, 1989 are hereby rescinded.

This Executive Order shall take effect immediately upon the date hereof.
