EMERGENCY PLANNING

WHEREAS, on October 17, 1986, President Reagan approved the "Super Fund Amendments and Reauthorization Act of 1986," 42 U.S.C. §11001-11050 (the Act) which contained new provisions for emergency planning; and

WHEREAS, among provisions of the Act is one which requires the Governor of each state to appoint a State Smergency Response Commission; and

WHEREAS, to the extent practicable, the Commission must be comprised of individuals with technical expertise in the emergency response field; and

WHEREAS, the Act authorizes the Governor to designate as the State Emergency Response Commission an existing state agency or an assembly of agencies or personnel thereof to serve as the Commission; and

WHEREAS, the Division of State Fire Marshal, the Emergency Management Agency, the Departments of Labor and Training, Snvironmencal Management, and Health, the Statewide Planning Council, the Governor's Office, and the Rhode Island League of Cities and Towns possess the necessary expertise and personnel to serve as members of the State Emergency Response Commission.

NOW THEREFORE, I, LINCOLN C. ALMOND, by the virtue of power vested in me as Governor of the State of Rhode Island and Providence Plantations, do hereby order as follows:

1. There is established a Rhode Island Emergency Response Commission, hereinafter referred to as "the Commission" which shall consist of the director or designee of the following: the Division of State Fire Marshal, the Emergency Management Agency, the Departments cf Labor and Training, Environmental Management, and Health, the Statewide Planning Council, the Governor's Office and a representative of the Rhode Island League of Cities and Towns. The State Fire Marshal shall act as Chairman.

2. The Commission shall perform all emergency planning, notifications, and reporting duties and acts prescribed by in the Act.

3. In designating emergency planning districts, the Commission shall use existing political subdivisions or aggregations cf existing political subdivisions.

4. The Division of Scats Fire Marshal shall serve as the primary agency for implementing the Act's emergency planning and notification requirements, while the Department of Environmental Management and the Department of Labor and Training shall serve as the primary agencies for implementing the Act's reporting requirements. The Department of Labor and Training shall have the lead on implementing sections 311 and 312 while the Department of Environmental Management shall be responsible for implementing section 313.

5. The Commission is authorized to accept such funds as may be made available to it or to carry out its responsibilities pursuant to the Act and this Executive Order.

6. In carrying out its responsibilities, the Commission is authorized to call upon any department, office, division or agency of the State to supply such data, reports or other information it deems necessary. Each department, office, division or acency of the State is authorized and directed to cooperate with the Commission and to furnish it with such information, staff and technical support as may be required by the Commission.

This Executive Order shall take effect immediately upon the date hereof.
