TO THE HONORABLE, THE SPEAKER OF THE HOUSE OF REPRESENTATIVES:

In accordance with the provisions of R.I. Gen. Laws § 43-1-4, I am transmitting herewith, with my disapproval, 95-H-6522, "An Act Relating To Labor and Labor Relations � Employment Security General Provisions."

This act would authorize the Director of the Department of Employment and Training to collect interest on recoveries of benefits improperly or excessively paid under the unemployment compensation system as a result of fraud or misrepresentation by the recipient.

I have signed into law 95-S-686, as amended, which is similar to this bill. Unlike this bill, however, 95-S-686 was amended to specify that any collected interest from unemployment insurance overpayments resulting from fraud or misrepresentation is to be deposited in the Employment Security Interest Fund created by Section 28-42-75 of the Rhode Island General Laws. This bill does not address the issue of where the collected interest on recoveries of improperly paid benefits is to be deposited.

For the foregoing reason, I disapprove of this legislation and respectfully urge your support of this veto.
