TO THE HONORABLE, THE SPEAKER. OF THE HOUSE OF REPRESENTATIVES:

I am transmitting to the Secretary of State, with my signature, 96-H-7833, Substitute A, "An Act Relating to Health Care."

This legislation would establish new, and clarify existing, criteria for the disclosure of health care information in the context of judicial, administrative and legislative proceedings. I support this legislation because it provides clear and commendable criteria for the disclosure of health care information in the context of these proceedings.

Last year, I vetoed a similar piece of legislation because it provided criteria for disclosure only in the context of judicial proceedings and completely prohibited the disclosure of health care information in the context of administrative and legislative proceedings. Such a blanket prohibition would have inappropriately interfered with the fact-finding imperatives of the State's administrative and legislative bodies.

The current legislation has been changed to allow disclosure of confidential health care information in the context of administrative and legislative proceedings to the same extent that such disclosure is allowed in the context of judicial proceedings. I would like to thank the sponsors for their cooperation in amending this legislation to ensure the proper functioning of those administrative and legislative bodies which require the disclosure of health care records.
