TO THE HONORABLE, THE HOUSE OF REPRESENTATIVES:

I am transmitting to the Secretary of State, without my signature, 2000-H 8154, "An Act Amending the Charter of North Providence." I take no action on this Act because it attempts to amend a Public Law that has already been superceded and is therefore ineffective.

This Act sets forth a staggered term system for the seven North Providence town council members and the term limits for each of their successors. This Act also establishes the amount of compensation to be paid to the town's council members and the mayor. The Town Council resolutions requiring this action did not reference the charier that was to be amended. The Act, however, amends Chapter 128 of the 1970 Public Laws incorporating the Town of North Providence. That 1970 charter, which provided for a town administrator, was superceded in its entirety by the charter of 1973, which established a mayor form of government for the Town.

By amending a superceded charier, the Act can be of no force or legal effect. Only an Act amending the presently existing charter of 1973 is effective. As such, to achieve the goal of this Act, a new bill would have to be passed amending the 1973 charier.

For the foregoing reasons, I will allow 2000-H 8154 to become law without my signature.
