This act deletes reference to a particular name brand epinephrine injection device, "EpiPen," and allows the use of an equivalent device to administer epinephrine. The legislation which this act amends, R.I. Gen. Laws § 16-21-22, requires the Departments of Health and Elementary and Secondary Education to promulgate policies, rules and regulation to provide for the health and safety of children identified as prone to anaphylaxis (exaggerated allergic reaction) and also authorizes school departments to administer "EpiPen," a brand name epinephrine injection device, to a child in an allergic emergency. When I allowed the legislation to become law last year, I expressed concern at the use of a particular name brand in our general laws, even where no other brand yet exists. At that time I was assured by the sponsor of the bill that this concern would be addressed at the next session. This act addresses my concern. As such, I sign this bill into law.
